Abstract EN

Penal order is a pre-trial penal follow-up and adjudication procedure that was initiated by the Algerian legislator in order to streamline penal procedures of minor crimes adjudication.

This procedure was provided for in the Code No.

15.2 concerning the amendment of Penal Code in the wake of the recurrent calls for simplification of procedures.

This procedure was also adopted following the example of numerous comparative legislations, as a vehicle to ease the burden on courts and expedite delivery of justice.

Although UAE and Algeria had lately adopted the said procedure, it was first adopted by Prussian Law in 1846.

This research is divided into two parts; the first of which sheds light on penal order concept setting forth definition, features, legal nature, and scope of the penal order.

The second part deals with penal order issuance – related procedures including the request to be submitted in the beginning and how this request could be decided over.

Second part also throws the spotlight on objection to the penal order, and penal order's binding force.

In its epilogue, the research concludes that the penal order is adopted by legislator with a view to striking a balance between prompt adjudication of cases and streamlining relevant procedures
