We have dealt with in this article with the study of the rule 49-51 %that has been introduced in the investment law for the year 2009 ,And raised many of political debate and economic debt reflected in the position of the Algerian legislature has fluctuated between devoted in Finance law 2009-2016 and excluded in the public procurement law and the new Act of investment.
Then we mentioned as it has tightened the legal forms for foreign investment targeting Algeria.
We have come to the conclusion that the essence of boosting the national economy is to better the investment atmosphere for the public and private, national or foreign sectors.

L’article a pour but l’étude de la règle 51-49% consacrée par la loi sur les investissements.
Une règle qui a posé beaucoup de questions au plan politique, économique et juridique.
Un débat qui a reflété sur la position du législateur algérien en la matière : entre sa consécration dans les lois de finances de 2009 et 2016, et son exclusion dans la loi des marchés publics et dans le projet de la nouvelle loi sur les investissements.
On a remarqué dans cette étude que la règle a réduit dans le flux des investissements directes étrangers en Algérie.
La solution primordiale pour l'économie nationale en est l’amélioration du climat d'investissement pour le secteur privé ou public, national ou étranger.
