In the field of environmental protection, the role of local authorities has remained marginalized by the Algerian constituent, despite the arsenal of legislative and regulatory texts enacted since the 1970s.
The effectiveness of environmental policy must pass By the consecration of broad constitutional prerogatives and recognition of these communities.
However, it was necessary to wait until 2016 that this recognition was recognized as part of the constitutional amendment.
This research seeks to study the constitutional amendment of 2016, through the competences granted to local and regional authorities regarding the protection of the environment as well as the limits of the intervention of these communities
Abstract FRE
Le rôle des collectivités territoriales en matière environnementale a été toujours marginalisé par le constituant algérien malgré l’existence d’un important arsenal législatif s’y rapportant depuis l’années 80.
L’efficacité de la politique environnementale est tributaire d’une reconnaissance constitutionnelle, au profit des collectivités territoriales, de larges compétences en la matière.
Une telle reconnaissance s’est réalisée en 2016 à l’occasion de la révision constitutionnelle.
La présente recherche vise à étudier la modification constitutionnelle de 2016 et ce, à travers les compétences accordées aux collectivités territoriales en matière de protection de l’environnement ainsi que les limites de leur compétences.
