The phenomenon of separation has grown up recently in the world specially after the new trends of great states towards granting minorities or ethnic groups (the interior self-determination or foreign selfdetermination ).

This means that minorities have the right to establish a state cut from the national sovereignty.

Thus presenting such project , however , has encouraged some minorities or some ethnic groups that localize geographically in certain region inside a state to ask for separation.

To study the issue of the legal basis of separation and note the overall required details of this research division two sections devoted to the first part of the statement of secession in light of the principles of international law and rules of procedure, either second topic has been allocated to a statement of the position of the judiciary separation.
