The Algerian law impose a legal protection to the contractual act concluded or executed on behalf the legal persons of public law with a view to protect integrity in that act by article 27 of the Law on prevention and fight against corruption relative to bribery in public procurements.
The study aims to demonstrate legal aspects related to the definition of contractual act within the meaning of article 27 of the Algerian law previously mentioned and according to the foreign penal legislations.

La loi algérienne a imposé une protection pénale de l’acte contractuel conclu ou exécuté au nom des personnes morales publiques en vertu de l’article 27 de la loi relative à la prévention et à la lutte contre la corruption (au sens large) ayant trait à la corruption en matière de marchés publics.
Cette étude a pour objectif de démontrer les principaux aspects juridiques relatifs à la définition de l’acte contractuel au sens de l’article 27 de la loi algérienne et de quelques législations pénales comparés.
