Abstract EN

Internal and international laws provide the right for legitimate defense .this latter have been set as an inherited right for individuals and groups.

the legislator of the international criminal court statute has attempted to quote domestic legislation and pass it on.

this task was difficult for the reason, that international judicial system is different from the internal one.

the present study will shed light on the issue in accordance with the Algerian domestic law by defining the basic concepts, terms and conditions that must be in both systems, in addition to indicating the extent of compatibility and contrast in the consecration of the concept of legal defense.
