Abstract EN

Despite the role of the International Criminal Court (ICC) in achieving justice and punishing the perpetrators of heinous crimes and combating impunity, the ICC by the virtue of its structure and mechanism, has become a new aspect of intervention in the internal affairs of countries, where the Super Powers (United States of America, Russia and China), with their influence on international system, which most of them are not members in the ICC, have authorized the UN Security Council (with its political status) the right to transfer criminal lawsuits to the ICC under Article (13/B) of the basic system of the ICC, which declines the value of complementary jurisdiction of the ICC, so that the national courts are no longer competent of dealing with those criminal lawsuits transferred to ICC by the UN Security Council.
