Children care is the responsibility• of the parents, but in the light of the father's and mother's departure to work they are forced to deposit their children with the competent institutions in the care of children under five, the preparatory education age that enables them to enroll at school.
Owing to the serious role played by these institutions, the Algerian legislator established its legal framework in 1992 but reorganized it in accordance with Executive Decree 08-287 of17/09/2008 setting the conditions for the establishment, organization, operation and control of small children's institutions and centers.
This decree includes the conditions of the establishment of these institutions, their function, their management and their control.

La garde des enfants est la responsabilité des parents mais depuis leur départ vers le monde du travail ils sont dans l’obligation de les déposer dans des institutions spécialisées.
Dans la prise en charge des enfants de moins de 5 ans, période préparatoire qui leur permet de rejoindre l’école, Compte tenu du rôle important joué par ces institutions le législateur algérien a établi le cadre juridique régissant le rôle des institutions en 1992 mais l’a réorganisé en vertu du décret exécutif 08-287 du 17/09/2008 qui fixe les conditions pour la création d’institutions et de centres d’accueil pour la petite enfance, son organisation, sa gestion et son contrôle, ce décret garantit les conditions de création de ces institutions et de leur gestion.
