Abstract EN

All praise is due to Allah, and peace and blessings be upon the Prophet after whom there shall be no prophet.

This research discusses one of the most important and most prominent issues in Islamic Jurisprudence, about which the dispute has spread among contemporary jurists, whether through jurisprudential councils, scientific bodies, specialized conferences and seminars, individual sayings in Ifta’, or jurisprudential research.

This matter is the ruling concerning the investment of zakat money by the guardian or his representative (the State) and its controls.

Therefore, through this research, I aim at collecting dispersed sayings and evidence, working as much as possible to document in order to reach a view about them, focusing on whether or not the ruling is permissible without going into the ramifications beyond the origin of the intended issue.

The most prominent findings of this research indicate the strength and breadth of the dispute even among the councils and the scientific bodies, and the preference of the position that it is permissible to invest zakat money by the guardian or his representative from governmental or charity agencies.

However, this position must not be absolute, since there must be some controls that restrict it, the most important of which are that this investment should be in the money that is available after disbursing the immediate needs of the beneficiaries of zakat, it should ensure a worthy interest for the beneficiaries, it should be in the legal areas, and it should be done by those who have competence, experience and honesty.
