English Abstract

The right to health is one of the most important rights among other basic human rights stipulated in the international conventions, declarations, agreements and resolutions.

Such conventions were made in order to develop clear and practical international standards that identify integrated health rights of all human beings and define the obligations of countries, and respect the various rights of patients.

Such topics are the domain of this study.

It also sought to discuss the Palestinian constitutional framework for health rights, the scope of constitutional protection and the guarantees of its application.

This is in addition to the reflections of such framework on the legislative treatment contained in the health-related laws and their conformity with international standards, both in its respect for the rights of the patient, or in its compatibility with the scientific developments as well as to other of issues.

The researcher concluded that there are weak points in the constitutional framework of health rights.

It lacks of guarantees of respect and applicability.

The laws regulating health issues lack harmony with international standards that requires the intervention of the legislature to remedy the shortage of legislative and constitutional imbalance, to remove the conflict, and to expand the scope of protection of health rights, and ensure their application.

This is in addition to other recommendations that were included in the conclusion of the study.
