ولاية الأم على أبنائها القصر : قراءة في المادة 87 من قانون الأسرة

Abstract EN

This paper deals with amendments to the Family Code of 2005, and more specifically the amendment to Article 87 related to guardianship of minors.

Article 87 has extended the cases of the mother’s right to guardianship over her minor child ren, to the exercise of the guardianship, even during the lifetime of the father, during the marriage, in the case of his absence or indisposition, or during the separation by divorce, whereas before the amendment he could not exercise it only in one case, if the father dies.

According to this article, the Algerian legislator gave also the mother the right to exercise guardianship in its entirety (psychological and financial) mainly, with some exceptions.

All of this will be illustrated in this paper.
