Under the constraint of lack of security and stability, or following unfavorable economic and social circumstances, some community groups are trying to emigrate to other countries in search of stability or to improve their living conditions, their desires are confronted with a set of legal procedures established by States to regulate access to their territory or the output of these territories procedures they often can not meet.

What drives them to transgress and become illegal immigrants.

And given that this phenomenon is associated with various crimes such as trafficking in human beings and organs, drug trafficking, organized crime and other cross-border crimes, the legislation has completed the implementation of criminal provisions in a attempt to reduce them, and the Algerian legislature like the other legislators that realized the seriousness of this phenomenon and thus criminalize illegal immigration of all kinds .., hence we pose the problem in which we try to answer in this article, which focuses on the effectiveness of the criminal provisions in force in Algerian law to the phenomenon of illegal immigration, particularly in terms of writing?
