The amendment of the investment code poses multiple problems.
On the one hand, the state tries to establish a competitive market economy that encourages private initiative.
On the other hand, the complementary finance law of 2009 and 2016, stipulates that the State has the right of preemption.
This study tries to demonstrate the legal basis of the right of preemption.
It deals with the way in which the Algerian legislator used it in public and private law to protect national interests.

L’amendement du code d’investissement, pose des problématiques multiples.
D’une part, l’Etat tente, d’instaurer une économie de marché compétitive qui encourage l’initiative privée.
D’autre part, la loi des finances complémentaire de 2009 et 2016, stipule que l’Etat a le droit de préemption.
Cette étude, essaye de démontrer le fondement juridique du droit de préemption.
Elle aborde la manière dont s’en est servi le législateur algérien, en droit public et privé en vue de protéger les intérêts nationaux.
