Abstract EN

The study has treated the theory of the de facto company according to the Algerian law.

The study similarly distinguishes the defining juristic characteristics of de facto company from other kinds of corporations like the ones already practicing and startups.

The study has also considered the Algerian lawmaker’s theoretical position from the facto companies as that law maker has shown a hesitancy and a preference for a real or traditional company.

Eventually, the study has focused on the extent to which the facto company can function, the consequences from fully acknowledging its existence and the ways in which it can be legally dissolved.
