Public transactions represent ,today ,an important mechanism for the development of the State's economy and promote economic investment and foreign partnership.

The mortgage by deposit possession represents a key mechanism ,proclaimed by the Algerian legislature under the provisions of the law on public transactions ,in order to facilitate the financing of the latter where the contracting service makes a late payment to the contracting parties after the full implementation of the procurement .This mechanism aims to ensure the resulting debts or resulting from the implementation of the agreement ,as well as the loans allocated in the financing of this contract.

Thus ,this study aims to identify and address the various procedures and legally prescribed criteria to regulate the mortgage possessory as a mechanism for bank financing of public transactions.
