The fixed-term contract has become widespread in recent times because of the current economic situation, which has provided flexibility in the establishment of industrial relations in order to create a dynamic balance in favor of the national economy .by reducing the unemployment rate on the one hand ,and on the other hand ensuring financial comfort for the benefit of economic enterprises .However ,the fixed-term employment contract remains an exception to that of indefinite duration ,although the Algerian legislator had evaded Article 12 of Law ,90/11 and considers these contracts as special cases and recommends their indefinite period .
This has been approved by social justice ,by the explanation of the ambiguity in the application of this type of employment contract.
