Abstract EN

The main aim of this study is to research the efficacy of legal rules signed by Montego bay (Jamaica) convention in 1982 and how it is suitable and convenient to ships affairs and activities and how it keeps pace with the development and how these ships pass through territorial sea, moreover its goal is to know juristic opinions that care about finding solutions to problems and disputes concerning maritime borders and ships transportation at the level of territorial waters especially that contains straits and archipelago under the current evolutions, this topic has not received any attention from despite its importance in studying rules of great international convention.

Some legal rules is clear but it has practical problems, such as; language ones concerning understanding texts or objective problems concerning the practical work to its rules, especially, that is innocent passing for foreign war ships and allow them to pass in case of safety for the maritime countries or follow and attack them.
