Abstract EN

This study aims at shedding light on the question of the requirement of marriage contract, the latter, which is entrusted by Allah to regulate and determine its effects.

The Family Code is governed by the provisions of the Islamic Shariah, which allowed the jurists to impose the principle of willing to redress the effects of this contract, in terms of certain limits and limitations.

In line with this, the family legislator referred to these provisions in article 19 of the Family Code, especially the polyglot and women's labor.

This may be due to the fact that the legislator considers these issues to be the most controversial application that may lead to marital disputes.

This is why legislators singled out them as a pre-emptive step to avoid post-marital conflicts.
