Abstract EN

The Ordinance No 15-02 of 23.7.2015 amending and supplementing the Code of Criminal Procedure contains provisions aiming at making fundamental changes in the functioning of the criminal justice system and the way in which the proceedings occurs ,to really concretize the role of justice in guaranteeing the rights and freedoms enshrined in the Constitution.

The introduction of the immediate appearance procedure aims to replace the equivocal procedures ,by necessity of equilibrating the criminal proceedings and assigning the prerogatives of imprisonment to a Court rather than to the public prosecutors office ,which is a part of the dispute.

This measure aims to achieve practical objectives in order to shorten the duration of disputes and to preserve time and effort and to simplify procedures ,in addition to avoiding unjustified imprisonment after the period of pre-trial detention necessary for the collection of evidence and the introduction of the suspect to trial at the nearest hearing
