انعقاد الزواج المختلط و آثاره : دراسة تحليلية نقدية في القانون الجزائري

Abstract EN

In some cases , the jurisprudence is trying to find solutions to many proplems raised by a lot of jurisdictions , among which ,the mixed marriage , that remains the most frequent , the case in which a man and a woman from different nationalities get married .This takes place in the presence of the content of different applied laws ( juridical rules ) which carry different concepts and depend on the kind of regime but without being monopolized by another law .Mean while , it be comes hard to find which law to apply when a couple or one of them holds the nationality of the country ( where thy life ) and this law will be foreign for one of them or both , some thing that urges the judge to take into account the social basic principles as they are linked to the regime , or depend on it .He, we mean the judge , will be obliged to exclude it ( the law ) if the state relies on the mechanisms targeting the elimination of the foreign competent law on the territory of the judge’s state whenever the conditions favorable to its practice aren’t imposed and so the exception becomes a law and vice versa.
