Abstract EN

This research dealt with the subject of the Father's Maintenance on his Child in the Islamic jurisprudence and the Algerian family law.

It aimed to highlight the importance of maintenance on the child under guardian ship which is one of his greatest rights, because it saves his life from loss, and protects his religion.

In addition, spending on a child protects him from corruption since this child is considered to be the future of the nation.

The research shows the views of scholars of Islamic law and jurists in the particulars of the matter and its details, and their evidences which were drawn from the Book( Quran), Sunnah ,consensus, and articles of the Family Code for jurists.

The nature of the subject required its division into an introduction , two sections and a conclusion.

The first section speaks about the father's maintenance on his child in the Islamic jurisprudence.

The second section speaks about the father's maintenance on his child in the Algerian family law.

The conclusion shows the most important findings of the research.

The most prominent of which are: 1- Maintenance is one of the greatest rights of the child after his parents' divorce.

It is also one of the most important functions of the nursery.

2- The general origin about the child maintenance and the place where he lives is to be from his own money.

If this child is poor, his maintenance will be the responsibility of his father.

In condition that this later is rich.

If the father is poor the maintenance on the child will be the responsibility of the mother.

But if the father and the mother are poor, the grand parents spend on the child.

And this is the opinion of the majority of the scholars.
