التعريف القانوني للصحفي المحترف : دراسة قانونية مقارنة في محددات الاحترافية في التشريع التونسي الجديد

Abstract EN

This text, entitled (Legal Definition of the Professional Journalist: A Comparative Legal Study of the Constitutive Elements of Professionalism in Tunisian Law), aims at developing research and enriching the theoretical and epistemological reflection on the question of the status of the Tunisian professional journalist from a comparative law perspective, especially the media French law which has strongly inspired the Tunisian legislator, editor of the two decrees: 115 on the Freedom of the press and publishing and 116 on the Freedom of the audiovisual press and the creation of the High Authority regulating the audio-visual media.

This is how we tried to specify the constituent elements of journalistic professionalism.

The objective is to develop a specialized doctrine to clarify the ambiguity still characterizing the legal texts governing the status of the Tunisian professional journalist whose job has remained open to all walks of life for decades.

Résumé (french) Ce texte qui s‟intitule ( Définition juridique du journaliste professionnel : Etude juridique comparé des éléments constitutifs du professionnalisme en droit tunisien), vise à développer la recherche et à enrichir la réflexion théorique et épistémologique sur la question du statut du journaliste professionnel tunisien dans une perspective du droit comparé, notamment le droit français des médias qui a fortement inspiré le législateur tunisien, rédacteur des deux décrets 115 sur la liberté de la presse et de l‟édition et 116 sur la liberté de la presse audiovisuelle et la création de la Haute autorité de régulation des médias audiovisuels.

C‟est ainsi que nous avons essayé de préciser les éléments constitutifs du professionnalisme journalistique.

L‟objectif étant de développer une doctrine spécialisée permettant de préciser l‟ambigüité caractérisant encore les textes juridiques régissant le statut du journaliste professionnel tunisien dont le métier est resté depuis des décennies ouvert à tous les horizons.
