Arabic Abstract

هدفت هذه الدراسة إلى الكشف عن آليات الوقاية من الفساد القضائي في القانونين الدولي و الأردني.

و بالتالي كانت إشكالية هذه الدراسة تدور حول مدى انسجام التشريعات الأردنية المتعلقة بالوقاية من الفساد مع اتفاقية الأمم المتحدة لعام ٢٠٠٣.

و لتحقيق ذلك فقد تم تقسيم هذه الدراسة إلى فصلين تناول الفصل الأول ؛ مفهوم الفساد بشكل عام و الفساد القضائي على وجه الخصوص، و أسباب الفساد و إشكاله، في حين تناول الفصل الثاني آليات مكافحة الفساد في الجانبين الوقائي و العقابي.

و قد خلصت الدراسة إلى أن التشريعات الأردنية المتعلقة بمكافحة الفساد عموما و الفساد القضائي على وجه الخصوص جاءت في إطارها العام منسجمة مع بنود اتفاقية الأمم المتحدة لمكافحة الفساد لعام ۲۰۰۳، و في المقابل فإن هناك بعض الاختلاف بين التشريعات الأردنية و اتفاقية الأمم المتحدة لمكافحة الفساد لعام ۲۰۰۳، خاصة فيما يتعلق بالمتاجرة بالنفوذ، و مفهوم الموظف العمومي، إضافة إلى أن المُشرع الأردني لم يأخذ فكرة التناسب بين الإفراج و جسامة العقوبة بخلاف اتفاقية الأمم المتحدة لمكافحة الفساد.

و في ضوء ذلك أوصت الباحثة بضرورة إعادة النظر لمادة (١٧٦) من قانون العقوبات الأردني و الخاصة باستغلال الوظيفة، بحيث تتحقق جريمة الفساد بمجرد حصول الموظف على منفعة من خلال وظيفيته حتى لو لم تكن المنفعة من معاملات الإدارة التي ينتمي اليها هذا الموظف، و ضرورة أن يأخذ التشريع الأردني بعيين الاعتبار التناسب بين الإفراج المبكر و جسامة الجريمة.

English Abstract

Combating judicial corruption in international law, law and Jordan This study aimed to uncover the mechanisms of prevention of judicial corruption in international and Jordanian law.

Thus, the problem of this study was the extent to which the Jordanian legislation on the prevention of corruption was consistent with the 2113 UN Convention.

In order to achieve this, the study has been divided into two chapters dealing with Chapter I: the concept of corruption in general and judicial corruption in particular and the causes and forms of corruption.

While the second chapter dealt with anti-corruption mechanisms on the preventive and punitive sides.

The study concluded that Jordanian legislation on combating corruption in general and judicial corruption in particular was in line with the provisions of the 2113 UN Convention against Corruption.

In contrast, there is some difference between Jordanian legislation and the UN Convention against Corruption in 2113, And the concept of a public official.

In addition, the Jordanian legislator did not take the idea of proportionality between the release and the severity of the sentence other than the United Nations Convention against Corruption In light of this, the researcher recommended reviewing article (176) of the Jordanian Penal Code concerning the exploitation of the job, so that the crime of corruption can be realized once the employee obtains a benefit through his job, even if the benefit of the management transactions to which this employee belongs is not necessary.

Jordanian legislation by giving consideration to the proportionality between early release and the gravity of the crime.
