English Abstract

The new regulation of licensee notary profession helps in providing flexible and timely suitable service to the citizens and investors.

Forasmuch the importance and sensitivity of the licensee notary profession by virtue of its representation of the law to prove and guarantee the rights of individuals by documenting transactions and aut henticate them in order to acquire legal status.

So, the Jordanian legislator granted a high level of importance to this profession by introducing a law of its own as a free profession licensed in the name of the law.

This study sheds light on the legal regulation of the licensee notary in the light of the Jordanian and the comparative laws to achieve the legal adaptation of the licensee notary liability and the nature of his responsibility towards the state, the customer and the others; by clarifying the elements and types of civil liabilities - within its both branches the contractual responsibility and the wrongful act – and clarifying the difference between them in order to conclude to the nature of licensee notary liability among the Jordanian law, which is characterized by its modernity.

The purpose of this study is to clarify the legal regulation of the licensee notary profession and the limitation of his liability while performing his duties.

Also, to determine the types of his liabilities toward the mistakes whether it was intentional ( deliberate ), unintentional or resulted by his negligence or omission.

The researcher finds that the licensee notary liability - between him and the client - is a contractual responsibility and his responsibility with the State and others is a wrongful act liability.

As this study is the first that studies the Jordanian Law of the licensee notary it’s considered as legal study that constitutes a brick in the field of scientific research.
