Arabic Abstract

جاءت هذه الدراسة بهدف الوقوف على موضوع في غاية الأهمية تمويل التأمينات الاجتماعية في القانون الأردني، حيث جاءت أهمية هذه الدراسة نظرا لأهمية نظام التأمينات الاجتماعية ذاته باعتباره وسيلة لانتشال الأشخاص المؤمن عليهم من المخاطر الاجتماعية والاقتصادية التي قد يتعرض لها الفرد، كمـا أنـه أصبح أداه مهمه في تمويل التنمية الاقتصادية وتحقيق الاستقرار الاقتصادي ومكافحة البطالة ورفع إنتاجية العامل.

و قد هدفت الدراسة إلى تحقيق مجموعة من الأهداف، أهمها توضيح مفهوم التأمينات الاجتماعية و خصائصها، و تحديد المخاطر التي تغطيها أنظمة التأمينات الاجتماعية، مع بيان مصادر تمويل التأمينات الاجتماعية، إضافة إلى توضيح التطبيقات الجديدة للتأمينات الاجتماعية في قانون الضمان الاجتماعي الأردنــي وهـي (تأمين الأمومة، تأمين التعطل عن العمل)، و كذلك توضيح الجزاءات المترتبة علــى مخالفة أحكام قوانين وأنظمة التأمينات الاجتماعية.

و في نهاية الدراسة توصل الباحث إلى مجموعة من النتائج والتوصيات، أهمها : أن العقوبات التي نص عليها قانون الضمان الاجتماعي لمكافحة ظاهرة التهرب التأميني عقوبات غير رادعه لمعالجة هذه الآفة التي تهدد النظام التأميني كله، حيث لم يعالج القانون هذه الظاهرة إلا بفقرة واحدة لم تغلظ فيها العقوبات إلا بحد أقصى غرامة مقدارها من (1000 إلى 2000) دينار حسب ما جاء في المادة رقم (100) من قانون الضمان، و هذا قدر من الغرامة لا يؤثر لأن منشأة متهربة بمبالغ تتجاوز عشرات الآلاف تغرم بعقوبات حدها الأعلى 2000 دينار.

لذلك يتمنى الباحث علــى المشرع الأردني إلى تغليظ العقوبات التي قررها في قانون الضمان الاجتماعي لسنة 2014، لأنها في رأي الباحث لا تفي بالغرض و غير رادعه، حيث لا بد من تعديل هذه العقوبات لكي تصبح من الشدة بحيث تردع كل المخالفين لأحكام هذا القانون، و ذلك حتى تستطيع المؤسسة أن تؤدي دورها الاجتماعي و الاقتصادي في المملكة.

English Abstract

The aim of this study is to examine the importance of social insurance in the Jordanian law.

The importance of this study is due to the importance of the social insurance system itself as a means of extracting the insured persons from the social and economic risks that the individual may be subjected to.

Financing economic development, achieving economic stability, combating unemployment and raising worker productivity.

The study aimed to achieve a set of objectives, the most important of which is to clarify the concept of social insurance and its characteristics, to identify the risks covered by the social insurance regulations, to clarify the sources of social insurance financing, and to clarify the new applications of social insurance in the Jordanian social security law On the work), as well as clarification of sanctions resulting from violation of the provisions of social insurance laws and regulations.

At the end of the study, the researcher reached a number of conclusions and recommendations, the most important of which are : The penalties provided by the Social Security Law to combat the phenomenon of insurance evasion are non-deterrent punishments to deal with this scourge that threatens the entire insurance system.

The law did not deal with this phenomenon except in one paragraph, Except for a maximum fine of 1000 to 2000 dinars as stated in Article 100 of the Guarantee Law.

This amount of fine does not affect the fact that an enterprise that evades amounts exceeding tens of thousands is fined with penalties of a maximum of 2000 dinars.

Therefore, the researcher wishes the Jordanian legislator to tighten the penalties he decided in the Social Security Act 2014, because in the opinion of the researcher does not meet the purpose and non-deterrent, as these must be amended to become so severe that deter all violators of the provisions of this law, The Foundation can play its social and economic role in the Kingdom.
