The war crimes are considered as the leading topics in the international criminal law because of the proliferation of armed conflicts at present.

the denying a fair trial cited in the annex paragraph (2 / a / 6) of article VII of the International Criminal court Statute in 1998 is one of the pictures of these heinous crimes of the war crime ,and this crime could be committed against civilians and captives .

The right principle to fair trial is one of the principles recognized in domestic legal systems, most State constitution provides for such right ,and criminalized the violation of this right, which is a true indication how the political system in the State respects the human rights and fundamental freedoms and its commitment to international conventions and charters devoted.
