Abstract EN

Damage resulting from aircraft noise upon flight or take off, whether related to individuals, buildings or facilities erected on the ground, has and still raises problems which govern consequent liability, be that on a legislative, judiciary or judicial level.

These problems include: determining and the extent to which such damages may be compensated or not, identifying the basis for liability for such damages and identifying those who are responsible for the stated damages.

This research represents a modest attempt to discuss the mentioned problems and the proposed solutions in light of what has been decided by legislations and as seen by the judiciary.
