Abstract EN

This article aims to highlight the negative aspects of the tradition of the Algerian constitutional founder of the French model in the control of the constitutionality of the laws, in the issue of constitutional priority approved by the French constitutional amendment 2008.

It has been shown through the analysis that the French Constitutional Council as an oversight mechanism arose for reasons specific to France and has been abandoned by some countries such as Morocco and Tunisia .

And that the overwhelming majority of the countries of the world adopted a constitutional court .

That the model of the Constitutional Council applied only in France and some of its former colonies.

Despite constitutional amendments to reform, but the Council is a model anomaly due to the continuing political nature, but with the preservation of the Constitutional Council as a purely French production, like the administrative judiciary, if France abandons them, what remains of the heritage t h a t b o a s t s o f i t ?
