Abstract EN

This research deals with a topic worthy of study and discussion.

The topic concerns the responsibility for the violation of the right of the tourist to be informed and the lack of accurate information regarding trips and tourist activities.

This calls for addressing the nature and legal basis of the obligation of travel and tourist agencies to inform the tourist, as well as the content and limits of this obligation and the nature of the liability resulting from the breach.

The aim of the study was to discover the nature and limits of the protection already guaranteed to the tourist through the right to be informed on all aspects of the tourism contract in the three comparative & legislations: the Algerian, the Emirati and the French.

The study also aimed to reveal their shortcomings in the light of the growing interest in tourism and its prosperity and the growing performance standards through a comparative analysis.

The research is divided into two parts: the first touches on the commitment to the right of tourists to be informed, the content such commitment and its limits.

The second part is devoted to the most important applications of violation to inform and the nature of responsibility resulting from it.

The research concluded that a tourist’s right to information should be provided by the Algerian and Emirati legislations in an independent law on tourist contracts.

The study also revealed that the commitment of the travel and tourist agencies is not only to take care in informing the tourist as a general rule, but also to achieve a result according to the modern trend of jurisprudence and justice.

The study also concluded that travel and tourist agencies are responsible for the actions of all support agencies they use in providing tourist services.
