Abstract EN

As a country whose economy is going through a transitional phase, Algeria seeks to find solutions that help it to activate the basic principles of market economy after setting the mechanisms that would assign to the state the role of organization and surveillance in the economic sector.

The public institution, as defined in different ways, is one of the most important forms of state intervention in economic activity.

The study of the public institution is legally linked to the traditional theory of public utilities and administrative law.

But there is no doubt that the transformation of this theory, i.e.

its modernization, leads to a shift in the legal nature of the public institution and the functions they perform.

Based on this, the question that the present paper addresses is the extent to which the legal framework of the public economic institution is in tune with the principles and rules of market economy and with the different mechanisms by which economic utilities are managed.
