The key to the jurisdiction of the ICC, its complementarity to national criminal jurisdictions under certain conditions.
In this sense, this principle finds a textual basis in the preamble of the Rome Convention as well as in Articles 1 and 17 of the Statute, which is of particular importance.
However, various obstacles must be overcome by the ICC in order for the principle of complementarity to be properly implemented.
It should be noted that these obstacles may violate the prosecution process against perpetrators of international crimes falling within the jurisdiction of the ICC, thus promoting impunity and the perpetration of new violations of international humanitarian and human rights law.
Is it possible to rely on complementarity as a remedy for impunity?

La clé de la compétence de la CPI, sa complémentarité aux juridictions pénales nationales sous certaines conditions.
Dans ce sens, ce principe trouve une base textuelle dans le préambule de la convention de Rome ainsi que dans les articles 1er et 17 du Statut, ce qui revêt une importance particulière.
Cependant, des obstacles d’ordres divers doivent être franchis par la CPI pour que le principe de complémentarité soit bien mis en oeuvre.
Notons que ces obstacles peuvent enfreindre la procédure de poursuite à l’encontre des auteurs des crimes internationaux relevant de la compétence de la CPI, favorisant ainsi l’impunité et la perpétration de nouvelles violations du droit international humanitaire et des droits de l’homme.
Est-il possible de s’appuyer sur la complémentarité comme un remède à l’impunité ?
