This research aims to discuss the digital forensic and evidences, and how it is differing from the traditional forensic.

It is discussed and suggested recommended methods to maintain a balance between the digital forensic and the data protection laws, also discussed the digital forensics and the mechanism of collecting digital personal data without violating the privacy of the personal data.

The relationship between General Data Protection Regulation (GDPR) and the digital forensic was one of the main points of discussion.

The research suggested some recommendation about how to deal with the data during the collecting of the digital evidence to reach the level of acceptance in the courts and to avoid violating the data protection laws at the same time.
