The subject of the guardian in the marriage of woman is one of the most controversial and debated topics between different views and intellectual currents, different in their orientations and convictions, which often have an impact on the legislator in the formulation of the provisions governing this subject.

Therefore, the positions of personal status laws in Arab countries are very different, despite their reliance on one source, which is the provisions of Islamic law.

The laws of some countries are in conformity with these provisions, without any change, addition or reduction.

Some of the countries have followed the provisions of Islamic law in general and have abandoned some of these provisions in line with the universal principle of equality between men and women.

While others have taken a different position, they have taken the provisions of Islamic law in form, and infringed in the content
