Abstract EN

In view of the développent of societies and the renewal of the needs of the people , especially in the marital and family relations , and the organization of these needs ,i twas necessary to find new updats to cope with the developments that were not specified by the Shari a and did not regulte them.therefore, the way to regulate these relations is to put the right of making conditions for the couple in the marriage contract or in a subsequent contract that they deem appropriate to ensure their rights and to avoid problems that may arise because of certain disputes for which no special legal text have been developed to regulate them.

Like the Islamic law , Algerian family law regulated the conditions in the marriage contract through the articl 19 however, this right was not absolute, but it has restrictions and condition so as not to violate the requirements of the mariage contract, that is not subject to the desires of each one of the couple, but organizes and clarify things between them and ensure their rights without contadiction with Islamic law or legle provisions
