This paper which tackles mortgage in the two Books "Da'aim Al-Islam" by AlQadhi Numan (363H/972) and "Shrai' Al-Islam" by Al-Muhaqiq Al-Hilli (676H/1277): A Comparative Study has the following findings: - Mortgage occupies a high position Islamic transactions.

Actually, it is one of the acceptable ways concerning financial crises.

- It is one of the economical transactions.

Thus, it is of interests of many scholars which is considered as the cornerstone of economy.

- In this paper, there is a focus on two pioneers one represents the Ismaili shia's thought, and the other demonstrates the Imami Shia's one in order to compare their opinions concerning this particular topic under investigation.
