Abstract EN

There are a lot of family problems from past to present.

These troubles have increased recently.

Teaching the social history for doctorate candidates , several studies on marriage and divorce have been written and published.

Accordingly, it is necessary to focus on the differences in the marital status between Mohammdian Sharia and Iraqi personal law no.188 dated1959 .

The paper consists of two aspects of discussion: Sharia and Law.

The Islamic history need a special interest and knowledge that enable the researcher to comprehend the topic.

This analysis is hence called the acquired knowledge that enables the researcher to conduct such a difficult work that encompasses law and religious sharia.

The current research has various entries.

The first is called an introduction explaining the most important terms used in this work linguistically and how being made explicit in Quran supported with examples.

The second part of the paper addresses the judicial separation as being mentioned in the personal law in Iraq exactly in the points of 40-46 referring to the lawful items together with discussions.

This paper also shows another subtopic which is "The reconciling of Family cases".

The third part of the work comprises the major portion of the study which is " Wife of a missing person" focusing on the religious laws concerning this topic.
