Abstract EN

Compulsory pharmaceutical licenses are related to the pharmacist›s obligation to exploit his patented invention .However ,the non-exploitation of pharmaceutical inventions in general is one of the problems facing countries in general and developing countriesin particular .The inventions granted to them are not exploited, especially in developing countries .Lack of exploitation by the owner of the pharmaceutical patent ,found a system of compulsory licenses for the purposes of the public interest of the community and to face the shortage of medicine ,and the system of compulsory licensing of pharmaceutical patents constitutes a restriction on the rights of the patent owner.which raisesthe following question ,Is the UAE legislator specifically regulated in the Industrial Property Protection Law for Compulsory Drug Licenses or only the general provisions of compulsory licenses contained in Federal Law No 17 .of 2002 regarding the regulation and protection of industrial property for patents and industrial designs?Also, what is the extent to which the flexibility of an agreement TRIPS and the Doha Declaration on the use of compulsory pharmaceutical licenses to preserve public health as a goal and a supreme interest of the State
