Abstract EN

Not only did the legislator leave the insurance contract to function automatically which would be similar to other contracts ,yet because of the specific type of insurance contract as well as the connection of insurance contract to the national economy ,the legislator decided to put a set of guarantees that support the implementation of the insurance contract for the twocontracting parties:the insurance provider and insurance receiver.

There is a clear pattern that the legislator surrounded the insurance in terms of ( the process and the contract )with several mechanisms that seek to achieve a certain path and many objectives that the legislator see as manifestations of economic and social success as well as enhancing the life and sustainability of this particular type of contracts .Therefore ,the view of this thesis will discuss the response and its extent in meeting the system of making contracts within the insurance process in order to guide the insurance contract towards ensuring the most effective implementation in the search for contractual justice
