The right to individual property is a constitutional right enshrined in the different constitutions of the world, The administration must follow a set of rules and legal procedures in case of individual expropriation for public benefit, the decision to declare a public benefit is the most important step in the process of expropriation, we will study in this article the administrative judge mission to control over the decision to declare a public benefit, In order to protect Individuals’ right ,and finally we present some applications of the administrative jurisdiction in Algeria
