Abstract EN

The Algerian legislator has organized the public procurement method, granting the contracting service several privileges and authorities that generally deal with the procurement, supervision and control of public procurement, this is what I will examine in this paper, through the analysis of certain legal texts, based on the analytical descriptive approach, in order to discover the vision of the legislature and the position of justice on the authorities acquired by the contracting service, to check whether the scope of the authority control and supervision do not exceed the arbitrarily prescribed limits in front of the contracting party, and to define the mechanisms to be followed to ensure the implementation of the terms of the execution of the contract under the control of the administrative justice in order to materialize the objectives set before the award of the contract.
