Arabic Abstract

هدف الدراسة : تهدف هذه الدراسة إلى معرفة حقيقة متأخرات الديون في المصارف و المؤسسات الإسلامية و معرفة أسبابها و الآثار الناجمة عنها، ثم البحث في الحلول التي تعمل على تقليص نسبة متأخرات المديونية، و ذكر حكمها الشرعي، و الغايات المقصودة منها.

منهج الدراسة : جمعت الباحثة بين المنهج الاستقرائي التحليلي الاستقصائي لما كتب في هذا الموضوع، و توضيح الحلول لمتأخرات الديون و إسقاط الحكم الشرعي عليها.

نتائج الدراسة : 1- متأخرات الديون تنتج عن أسباب فردية أو مصرفية غير السياسات الاقتصادية الممنهجة من أجل السيطرة 2- إيجاد بعض الحلول الشرعية من أجل الحد من متأخرات الديون، مثل إعادة توزيع الأقساط المتأخرة من غير فوائد مالية، و حسم جزء من الأقساط.

توصيات الدراسة : 1.

توصي الباحثة بعمل دورات دورية فقهية معاصرة و مستجدة لتعليم الموظفين في المصارف الإسلامية، ليكونوا على اطلاع بالمسائل الفقهية، و نصوص التشريعات، و عمل دورات تثقيفية في دراسة الواقع الربوي 2.

توصي الباحثة أن يفرغ العلماء جهدهم في دراسة المسائل العصرية، و عدم انتظار وقوع المشكلات لدراستها.

ضرورة اهتمام أهل العلم بالأبحاث و الدراسات المتعلقة بموضوع متأخرات الديون، و إيجاد حلول شرعية أكثر تتناسب مع التطور السريع و التقدم المستمر.

English Abstract

Objective of the study : This study aims at identifying the real status of debt arrears in Islamic banks and institutions, and figuring out their causes and effects, then finding solutions that reduce the percentage of debt arrears.

This is inaddition to clarifying its Islamic rulings and the objectives behind them.

Research methodology : To conduct this study, the researcher combined between the comparative, survey and inductive approachs.

It investigates the written literature relevant to this subject, and clarifys the solutions to debt arrears then applies the Islamic ruling thereon.

The most important findings of the study : 1.

Debt arrears are caused by individual or bank reasons, in addition to the economic policies that are structured for control.

2.

Finding some Islamic Sharia solutions to reduce debt arrears, such as redistribution of late installments without interest, and deducting part of the installments.

The most important recommendations of the study : 1.

The researcher recommends creating modern jurisprudence courses to teach employees in Islamic banks to be familiar with the jurisprudential issues, the texts of the legislations, and conducting educational courses relevant to of the status that is based on usury.

2.

The researcher recommends that scholars should devote their efforts to studying modern issues and not waiting for problems to befall in order to be studied.

3.

There is a need for drawing the attention of scholars to research and studies on the subject of debt arrears, and to find more legal solutions, commensurate with the rapid development and continuous progress.
