Arabic Abstract
يتناول هذا البحث دراسة أثر الجرائم الدولية على الحصانة الدبلوماسية التي يتمتع بها المبعوث الدبلوماسي، و بيان سلطة الدولة الإسلامية في محاسبة المجرمين الدوليين وذلك في فصل تمهيدي.
و فصلين آخرين.
تناول الباحث في الفصل التمهيدي التعريف بالحصانة الدبلوماسية و أنواعها و نطاقها الشخصي و تكييفها الفقهي، أما الفصل الأول فكان لبيان حقيقة الجرائم الدولية و خصائصها و أركانها و أنواعها و الأساس الشرعي لتجريمها و في الفصل الثاني بين الباحث أثر الجرائم الدولية.
على الحصانة التي يتمتع بها المبعوث الدبلوماسي و سلطة الدولة الإسلامية في محاسبته على جرائمه سواء ارتكبت داخل اقليمها أم خارجه في ضوء الإسلامي.
واعتمد الباحث على المنهج التحليلي لبيان مفهوم الحصانة الدبلوماسية و أنواعها و تعريف الجريمة الدولية و أركانها و ما تتميز به عن الجرائم الأخرى و بيان أثرها على الحصانة الدبلوماسية و كذلك اعتمد على المنهج الوصفي في بيان خصائص الجريمة الدولية و معيار تميزها عن الجرائم الأخرى.
توصل الباحث إلى مجموعة من النتائج أهمها أن الحصانة الدبلوماسية حق يمنح للمبعوث الدبلوماسي لتسهيل أداءه لمهامه فهي لا تتعلق بشخصه بل بوظيفته وأن الإسلام سبق الغرب في تقرير هذه الحصانة للرسل و منع الاعتداء عليهم وخطورة الجرائم الدولية و تأثيرها على الحصانة الدبلوماسية من حيث إنها تسقط هذه الحصانة عن المجرم الدولي المسلم بحيث تملك الدولة الإسلامية السلطة في محاسبته سواء ارتكب جرائمه داخل اقليم الدولة الإسلامية أم خارجه، و كذلك بالنسبة للمجرم الدولي المقيم داخل إقليم الدولة الإسلامية.
و خلص الباحث إلى جملة من التوصيات أهمها : الجرائم الدولية و تأثيرها على الحصانة الدبلوماسية و تدريسها ضمن مساقات الجامعات و إبراز دور الفقه الإسلامي في محاربة الجرائم الدولية والحد منها حيث كان له السبق في تحريمها وتقرير العقاب عليها بنصوص شرعية ملزمة.
English Abstract
This study examines the impact of international crimes on the diplomatic immunity of a diplomatic envoy, and shows the power of the Islamic state to call to account international criminals.
This study consists of an introductory chapter and two others chapters.
In the introductory chapter, the researcher defines diplomatic immunity, and shows its types, its personal scope and legal adaptability.
The first chapter clarifies the true nature of international crimes, their characteristics, their elements, and the legal basis for their criminalization.
The second chapter examines the effect of international crimes on the immunity of the diplomatic envoy and the authority of the Islamic state to call him to account for his crimes whether committed within its territory or outside in the light of Islamic jurisprudence.
The researcher used the analytical approach to explain the concept of diplomatic immunity and its types, the definition of international crime and its elements, its characteristic of other crimes, its impact on diplomatic immunity, and the descriptive approach for defining the characteristics of international crime and the criteria that distinguish it from other crimes.
The researcher concluded a number of findings the most important of which is that the diplomatic immunity is a right granted to the diplomatic envoy to facilitate his performance.
It is not personal but related to his job.
Islam preceded the western world in granting this immunity to envoys and preventing aggression against them and showing the seriousness of international crimes and their effect on diplomatic immunity where it drops this immunity of the Muslim international criminal.
The Islamic state has the power to hold him accountable whether he committed his crimes within the territory of the Islamic State or outside, as well as for the international criminal resident in the territories of the Islamic State.
The researcher drew a number of recommendations, the most important of which are: Teaching international crimes and their impact on diplomatic immunity in university courses and highlighting the role of Islamic jurisprudence in combating international crimes and reducing them where Islam had the lead in prohibiting them and setting forth their punishment in binding legal texts.
