Arabic Abstract

إن الشريعة الإسلامية جاءت رعاية لمصالح العباد و دواء للمفاسد، حيث جعلت الإمام ينوب عن الأمة في تحقيق مصالح الناس الدينية و الدنيوية، لنيل سعادتهم و صولا لثواب الآخرة.

و لقد تركت الشريعة للإمام مجالا واسعا في تقدير كثير من الصلاحيات، و منها فرض الإقامة الجبرية على بعض الأشخاص بتقييد حريتهم، و منعهم من التنقل من مكان لآخر، فهذا البحث يدرس سلطة الإمام في فرض الإقامة الجبرية، حيث جاء الفصل التمهيدي يبين حقيقة ولي الأمر في اللغة و الاصطلاح، و العلاقة القائمة بين الولي ورعيته في الحقوق و الواجبات، و دوره في تقيد الحريات، ثم تطرقت في الفصل الأول عن حقيقة الإقامة الجبرية، و ارتباطها بالحبس، مبينا أنواع الإقامة الجبرية من حيث اعتبار الزمان في مدة الإقامة الجبرية، و اعتبار مكان الإقامة الجبرية خاصا، أو عاما، مفردا الإقامة الجبرية الإختارية، و ذكرت ضمن الفصل أن الإقامة الجبرية يعتريها عدة أحكام كالوجوب، و التحريم ، و الجواز، ثم الحديث في الفصل الثاني عن ضوابط الإقامة الجبرية و تكييفها الفقهي، و بينت أنها ليست مطلقة، بل مضبوطة بالشرع، و تناولت التكييف الفقهي للإقامة الجبرية، من حيث كونها تعبدية، أو عقوبة، أو احترازية، و في الفصل الأخير، تحدثت عن آثار الإقامة الجبرية على المصالح العامة و الخاصة، محاولا أن أسبر جوانب الموضوع بالخاتمة، المتمثلة جلا من النتائج التوصيات، سائلا الله التوفيق.

English Abstract

The Islamic Sharia cares for the interests of the people and the prevention of evil deeds.

Sharia, for this purpose, made the Imam to represent the nation in achieving the religious and life interests of people, to achieve their happiness in life and get the reward of the Hereafter.

The Sharia has given the Imam considerable scope and space in assessing many powers, including the imposition of house detention of some people by restricting their freedom and preventing them from moving from one place to another.

This research examines the power of the imam to impose house detention.

The introductory chapter of this study explains the concept of the guardian both linguistically and technically, and the relationship between the guardian and his people in the rights and duties, and his role in the restriction of freedoms.

The first chapter explains the concept of house detention and its relation to imprisonment, indicating the types of house detention in terms of time and place whether personal or public place.

The chapter also explains the provisions of house detention such as such as the necessity, prohibition, and permissibility.

It also shows that this detention might be personal option for worshipping purposes.

The second chapter explains the rules of house detention and its juridical adaptation.

This chapter shows that house detention is not absolute, but is controlled by Sharia law.

The chapter also addresses juridical adaptation for house detention as a worshipping act or punishment, or a preventive act.

The last chapter explains the effects of house detention on public and private interests, in an attempt to explore the final aspects of the subject, which is one of the recommendations.
