Arabic Abstract
تتناول الرسالة موضوعا مستجدا في واقعنا المعاصر، ظاهرة انتشار الكذب و التدليس و الخيانة في المعاملات المالية، تداولت في الرسالة موضوع أثر الكذب في المعاملات المالية من خلال بيان مفهوم الكتب و حكمه و رخصه و بيان أثر الكتب على فسخ العقود المالية، و تقدير التعويض الناشئ عن الكذب في العقود المالية، و تناولت جزيئات هذا الموضوع في ثلاثة فصول، جاءت على النحو التالي: الفصل الأول : حقيقة الكذب، و حكمه، و فيه مبحثان : المبحث الأول : حقيقة الكتب، المبحث الثاني : حكم الكتب و رخصة في الشريعة الإسلامية.
الفصل الثاني : أثر الكذب على العقود المالية و فيه أربعة مباحث، الأول : حقيقة عقود المعاوضات و أنواعها، الثاني : أثر الكذب على فسخ عقود المعاوضات الثالث : حقيقة عقود التبرعات و أنواعها.
الرابع : أثر الكتب على فسخ عقود التبرعات.
الفصل الثالث : أثر الكتب على التعويض عن الضرر في العقود المالية و فيه ثلاثة مباحث : الأول : حقيقة التعويض و شروطه و أسبابه الثاني أثر الكتب على التعويض عن الصور في عقود المعاوضات، الثالث : أثر الكتب على التعويض عن الضرر في عقود التبرعات ...
ثم جاءت الخاتمة لتشمل أهم النتائج و التوصيات و الفهارس
English Abstract
This study discusses a recently new subject in the contemporary world in which lying, fraud, dishonesty and breach of trust have become a common phenomenon in financial transactions.
The objective of this study is to examine the impact of lying in financial transactions through explaining the concept of lying, its rulings and permissibility, and showing the impact of lying on the termination of financial contracts as well as estimating indemnity resulting from lying in financial agreements.
The study is divided into three chapters, the synopsis of which is as follows: Chapter One : The concept of lying and its rulings from Islamic perspective.
The chapter is divided into two topics the first of which is about the nature of lying while the second one is the ruling of lying and its permissibility in Islamic Sharia.
Chapter two : the impact of lying on financial contracts which has four topics; the first is the true nature of netting contracts and types.
The second: the impact of lying on termination of netting contracts.
The third discusses the essence of pledges (donation agreements).
The four is relevant to the impact of lying on the termination of pledges.
Chapter Three : discusses the impact of lying on indemnity of damages in financial contracts.
The chapter has three main topics the first of which is about indemnity, its conditions and causes.
The second explains the impact of lying on indemnity of damages in netting contracts.
The third topic illustrates the impact of lying on indemnity of damages in pledges.
The conclusion of the study lists the most important findings and recommendations of the study as well as indexes.
