وسائل مراجعة أحكام التحكيم في القانون الإماراتي : دراسة مقارنة

Abstract EN

This study deals with the opinion of the Emirati legislator regarding the request to interpret an unclear arbitration award, correct it, or issue additional provisions to supplement it and compare it with other legislative, judicial, and jurisprudence opinions, so as to reach solutions that are applicable in the UAE.

Firstly, this study focuses on the interpretation of unclear awards, where it explains the conditions of interpretation, its methods, its procedures, the interpreting authority, and the outcome of interpretation.

Secondly, it examines the subject of correcting mistakes in arbitration awards, the nature of the mistake, its conditions and the authority that is responsible for dealing with such requests.

Thirdly, it studies the requests ignored by the arbitrator, the competent authority that are supposed to deal with them, the rules governing their issuance as well as their legal force.

The author concludes with the main results and recommendations he reached.
