Arabic Abstract

تختص هذه الدراسة بإلقاء الضوء على حكم استثمار الأموال الخيرية، و أثر التصرفات المالية الناشئة عن الاستثمار على كافة فئات المجتمع ؛ حيث إن لهذا الموضوع أهمية بالغة في تنقية الأموال الخيرية مما يشوبها من الزلل و العمل على تنميتها بما يحقق كفاية حاجات المستحقين ؛ لذا قسمت الرسالة إلى ثلاثة فصول و خاتمة.

و قد بدأ هذا البحث بالفصل الأول : حقيقة الاستثمار و ضوابطه.

و يتضمن هذا الفصل حقيقة الاستثمار، و حكمه و مقاصده، و الضوابط التي تحكم استثمار الأموال في الإسلام بطريقة تحقق المصلحة و تدفع المفسدة عن الأمة، و من ثم بيان الشرائط التي يجب توافرها في كل ركن من أركان العملية الاستثمارية حتى تكون معتبرة في نظر الشارع.

ثم جاء بعد ذلك الفصل الثاني : حقيقة الأموال الخيرية و أنواعها وحكم استثمارها وضوابطه و شرائطه.

و يتناول أنواع الأموال الخيرية، و الفئة المستهدفة من جمع المال الخيري، ثم بيان حكم استثمار الأموال الخيرية بأنواعها سواء كانت واجبة أو مندوبة، و كذلك يوضح شرائط و ضوابط استثمار المال الخيري، و قد تخلله بيان المعوقات التي تعتري عملية الاستثمار لتلك الأموال.

و أخيرا الفصل الثالث : أثر التصرفات المالية الناشئة عن الاستثمار.

و هو يعالج أمورا عديدة منها، أثر الاستثمار على المستثمرين و المنتفعين و المجتمع، و ذلك من خلال عدة مسائل منها مسألة الصفة الشرعية ليد المستثمر، و مسألة المخاطرة بالمال الخيري، و أثر مجاوزة المستثمر حدود الوكالة و ترتب الضمان عليه، و أثر الاستثمار في حفظ الأموال، و عائد استثمار كفالات الأيتام والتبرعات و تحقيق الرفاهية و تعليم المنتفعين، و كذا دور الدولة في تنمية و استثمار المال الخيري، و كذلك العائد على المجتمع من النواحي الاجتماعية و الاقتصادية و نهضة الأمة.

و ألحقت ذلك كله بخاتمة دونت فيها أهم النتائج و التوصيات.

English Abstract

This study sheds light on the provisions on investment of charitable funds and the impact of financial behaviour arising from investment on all segments of society.

This topic is of great importance in the development of charitable funds, which are hampered by shortcomings and to work on their development to meet the needs of the beneficiaries.

The study is divided into three chapters and a conclusion.

The first chapter addressed the reality of investment, its provisions and purposes, and the rules governing the investment of funds in Islam in a manner that achieves interest and eliminates corruption in the Muslim nation.

The chapter then states the conditions that must be available in every pillar of the investment process so as to be considered by the public.

The second chapter dealt with the types of charitable funds, the target group by collecting charity money, and then explained the ruling on the investment of charitable funds of all kinds, whether obligatory or voluntary, as well as clarifying the conditions and controls of the investment of charitable funds.

The chapter also addressed identifying the legitimate ways and fields through which charitable funds can be invested and stated the obstacles facing the process of investment of those funds.

Finally, chapter three examines the effect of financial behaviours arising from investment.

It dealt with many issues, including the impact of investment on investors, beneficiaries and the society, through several issues including the question of legitimacy of the investor, the issue of risk of charitable money, the impact of the investor's overstepping the limits of the agency, the extent of permissibility granted to the investor in taking from charitable funds.

The chapter addressed the effect of investment in preserving funds and achieving welfare and educating beneficiaries, as well as stating the role of the state in the development and investment of charity money.

Also, it looked into the benefits to the society socially and economically.

The study ended with a conclusion that stated the most important conclusions and recommendations.
