يتناول هذا البحث قضية هامة من قضايا الفقه الإسلامي في باب الأحوال الشخصية تتعلق بإثبات الزواج و الطلاق غير الموثق في الهيئات الرسمية، و الآثار المترتبة عليه - بدأ البحث ببيان حقيقة التوثيق في عقد الزواج و الطلاق، ثم تحدث عن لمحة تاريخية عن التوثيق، أتبعها بأنواع التوثيق و مدى أهميته.
- تناول حقيقة الهيئات الرسمية و غير الرسمية، و اجراءاتها في التوثيق، ثم أهمية التوثيق و أسباب تركه مع بيان الحكم التوثيق مع الرأي الراجح.
- عالج البحث موضوع كيفية إثبات عقد الزواج والطلاق غير الموثق عند الإنكار وعند عدم الإنكار، كما إنه عالج كيفية فسخ عقد الزواج و الطلاق غير الموثق عند الإنكار و عند عدم الإنكار.
- تحدث البحث عن وسائل الاثبات الرسمية و غير الرسمية مع بيان الفرق بينهما، و أهمية كل واحدة منهما.
- كما تحدث البحث عن الآثار و الحقوق المترتبة على إثبات عقد الزواج غير الموثق، و كذلك الآثار و الحقوق المترتبة على فسخ عقد الزواج غير الموثق، و في النهاية بين البحث الآثار القانونية على أطراف عقد الزواج من الزوجين و الأولاد حال ترك التوثيق.
و أخيرا انتهى البحث بأهم النتائج التي توصلت لها الباحثة، و كذلك أهم التوصيات التي أوصت بها الباحثة.
English Abstract
This study illustrates an important issue of Islamic Jurisprudence and Personal Status Act which is relevant to proving undocumented marriage and divorce before official bodies, and the implications thereof.
The research starts with explaining the truth of documenting marriage and divorce agreements.
Then it provides a historical overview of the documentation, followed by the types of documentation and its importance, then an explanation of the documentation rules and the correct opinion relevant to it.
It also explains the fact of official and non-official bodies and their procedures in documentation.
The researcher discusses the issue of how to prove and termination of undocumented marriage and divorce in the state of denial and abstention.
She also explained the means of proof, official and non-official and the difference between them, and the importance of each one of them.
The conclusion of the research explains the effects and rights resulting from proving the undocumented marriage agreements as well as its termination, indicating the legal effects on the parties of the marriage agreement; the spouses and children if the documentation is neglected.
Finally, the research ended with the most important findings and recommendations of the researcher.
