Arabic Abstract

تتناول هذه الدراسة لمسألة فقهية معاصرة، وهي أثر قول الخبير في التعويض عن الضرر الواقع في المعاملات المالية المعاصرة، وحتى تؤتي الدراسة ثمارها فقد جعلتها في فصل تمهيدي وثلاثة فصول على النحو التالي : الفصل التمهيدي : تكلمت فيه عن حقيقة قول الخبير و حجيته، و شروطه، و علاقته بوسائل الإثبات، و بيان حقيقة التعويض عن الأضرار و أسبابه.

الفصل الأول : تداولت فيه أثر قول الخبير في التعويض عن الأضرار المالية في المرابحة للأمر بالشراء كما تجريها المصارف الإسلامية، و بيان بعض الصور المعاصرة، كالرد بالعيب، و مخالفة مواصفات السلعة، و نكول المشتري عن شراء السلعة التي أمر بشرائها.

الفصل الثاني : جعلته في أثر قول الخبير في التعويض عن الأضرار المالية في شركات المقاولات، موضحا ذلك بصور معاصرة، كعدم إتمام محل العقد، وعدم تمكين المقاول من الشروع في محل العقد، أو رفض استلامه الفصل الثالث : كان في أثر قول الخبير في التعويض عن الأضرار المالية في التأمين التكاملي مع ذكر بعض الصور المعاصرة، كإخفاء البيانات عن المؤمن له أو له، المحاباة في التعويض، أو عدم تقديم المؤمن له المعلومات و الوثائق الصحيحة.

و قد توصل الباحث إلى جملة من النتائج أهمها : الخبير هو الشخص الذي يتوفر فيه ما يكفي من العلم و الدراية في فن من الفنون للاستعادة به و الرجوع إليه للاستئناس بقوله في قضية ما بطلب من القاضي.

الاستعانة بالخبراء في أي فن من الفنون الدقيقة هو مرجع مهم للقاضي النشاطات التجارية و الصناعية و التكنولوجية للبت في القضايا، و فض النزاعات.

English Abstract

This study examines a contemporary juristic question, which is the impact of the expert's opinion on indemnity for the damages in contemporary financial transactions.

In order for the study to achieve its objectives, it was divided into an introductory chapter and three other chapters as follows :  The introductory chapter : it explains the nature of the expert's opinion, its authority, conditions, and its relation to the means of proof.

The chapter also explains the truth of indemnity for damages and its causes.

 The first chapter explains with the effect of the expert's opinion on indemnity in financial damages in Murabaha for the purchase orderer as carried out by the Islamic banks, and the shows some contemporary examples such as the return for defect and the violation of the specifications of the commodity, and relinquishing of the purchase orderer.

 Chapter Two explains the impact of the expert's opinion in the indemnity for financial damages in the construction companies, explaining it con by temporary examples, such as not completing the subject of a contract, and not enabling the contractor to start the subject of the contract, or refusing to receive it.

 Chapter Three illustrates the effect of the expert's opinion on indemnity in financial damages in the integrative insurance, with some contemporary examples, such as concealment of data from the insured, favoritism in indemnity, or failure to provide the insured with the correct information and documents.

The most important findings of the study :  The expert is : a person who has sufficient knowledge in a certain field to be refer to seek his opinion in a case upon the request of the judge.

 Requesting the help of experts in any field is an important reference to the judge due to the expansion of commercial, industrial and technological activities, so as to decide issues, and resolve disputes.
