The judge's discretionary power plays an important role in matters of international judicial delegation when it is required of him to take probative procedures outside his jurisdiction and outside his international jurisdiction , such as when the witness and the opponent exist in a place outside the judge's area of place jurisdiction .

What is the extent of discretionary power granted to the judge when rendering judgment in the case presented to him , whether the probative procedure –related judgments is rendered by him or by a foreign judge? The juristic opinions are numerous have expanded regarding it whit the dearth of legislation tackling the subject of international delegation generally and the judge's discretionary power in cases related to it in particular .
