Arabic Abstract

الجنسية الفلسطينية مرت بالعديد من الحقب التاريخية و السياسية التي تعرضت لها دولة فلسطين، و لم تحظ الجنسية الفلسطينية على مر التاريخ استقرارا حتى هذه اللحظة، و ذلك للعديد من الأسباب الداخلية في الدولة الفلسطينية، منها أسباب سياسية و قانونية و اجتماعية.

تناولت هذه الدراسة الحماية الدستورية و التشريعية للجنسية في القانون الفلسطيني و الأنظمة القانونية المقارنة في العالم، و الوقوف على القصور الذي شابت التشريعات الفلسطينية في فلسطين، و معالجتها من خلال دراسة النصوص القانونية في التشريعات المقارنة، و حيث أن الجنسية الفلسطينية تنظمها للأسف قانون وحيد و هو مراسيم الجنسية الفلسطينية الموحدة (١٩٢٥-١٩٤١م) الصادرة عن الانتداب البريطاني في ظل الانتداب البريطاني على فلسطين و ما زال العمل بهذا القانون حتى اليوم.

من الدراسة تبين للباحث أن القانون الذي ينظم الجنسية الفلسطينية بشكل خاص ومستقل هي مراسيم الجنسية الفلسطينية الموحدة كما رأينا، و بالتالي من خلال الاطلاع على النصوص القانونية لهذه المراسيم في تنظيمها للجنسية، فقد اعتراها القصور الواضح و الجلي في حمايتها للجنسية من حيث تنظيم أحكام منح أو فقد أو استرداد الجنسية، و من حيث تنظيم الحماية القضائية للجنسية، و الهدف من بعض النصوص التي جانبت الصواب هو خدمة المصالح البريطانية الأمريكية الصهيونية بشأن مستقبل فلسطين، و قيام الدولة اليهودية على أرض فلسطين.

و من خلال مقارنة هذه الدراسة وفق منظور الشريعة الإسلامية، تبين أنها الأسبق في معرفة المواطنة قبل أربعة عشر قرنا، و ذلك بتقسيم الإسلام للعالم إلى قسمين : القسم الأول دار الإسلام ( المواطنة الإسلامية )، و دار الحرب ( الأجانب )، و التي عرفتها الأنظمة القانونية الوضعية المعاصرة و المقارنة بمصطلح الجنسية، فالإسلام عرفها من حيث مفهومها و موضوعها و لم يعرفها بمصطلحها المتعارف عليه في الوقت المعاصر، و من قبيل الحماية فقد قرر الإسلام مجموعة من الحقوق التي من خلالها يتم حماية المواطنة، سواء كان المواطن مسلم أم غير مسلم و يعيش في الدولة الإسلامية، و من هذه الحقوق التي ذكرها القرآن الكريم و السنة النبوية و الأثر الحق في التمتع بالمواطنة و عدم الحرمان منها، و الحق في العدالة، و الحق في الكرامة و غيرها من الحقوق الكثيرة.

English Abstract

The Palestinian nationality has passed through many historical and political periods which the State of Palestine has been subjected to, and every stage in Palestine was considered a transitional period for the Palestinian nationality.

As such, the Palestinian nationality has not seen any stability throughout history for many internal reasons, some of which are political, legal and social.

This study addresses the constitutional and legislative protection of nationality in the Palestinian law and the comparative legal systems in the world.

It also examines the shortcomings of the Palestinian legislations in Palestine and addresses them through studying the legal texts in comparative legislations, especially that the Palestinian nationality is unfortunately regulated by a single law, which is the Palestinian unified citizenship decrees (1925-1941) issued by the British Mandate under the British Mandate over Palestine.

This law is still in effect today.

The study shows that the only law applied in Palestine to the Palestinian nationality is the Palestinian unified citizenship decrees, as we have seen, and thus through examining the legal texts of these decrees in their regulation of nationality, it becomes quite obvious that glaring shortcomings are evident in their protection of nationality in terms of regulating the provisions of the granting, loss or restitution of nationality, as well as the regulation of the judicial protection of nationality.

The purpose of some ill-advised texts was to serve the British-American and Zionist interests on the future of Palestine, and the establishment of the Jewish state on the land of Palestine.

By comparing this study according to the perspective of Islamic law, it was found that the latter was the first to know about citizenship fourteen centuries ago, whereby Islam divided the world into two parts: the first part is the House of Islam, Dar Al-Islam, (Islamic citizenship) and the House of War, Dar Al-Harb (foreigners), which have been defined by contemporary and comparative positive legal systems as nationality.

Islam defined it in terms of its concept and subject matter, and not in terms of what it has become customarily known in modern times.

As for citizenship protection, Islam has decided on a set of rights through which citizenship is protected, whether a citizen is a Muslim or non-Muslim living in the Islamic state.

Of those rights mentioned in the Quran, the Prophetic Sunnah, and the Hadith (the sayings of the Prophet) are the right to the enjoyment of citizenship and not to be deprived of it, the right to justice, and the right to dignity, and many other rights.
